Welcome to Casopra. The terms "we", "us" and "our" refer to Casopra. Casopra operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Casopra is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein, including our Privacy Policy, Shipping Policy, Return & Refund Policy, Delivery & Returns page and Terms of Purchase, describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully. By visiting, interacting with, purchasing from or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access the Services.

1. Access and Account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province or country of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide information such as your name, email address, billing information, payment information, shipping information and account information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign or license your account to any other person. We may refuse service, suspend access, cancel orders or restrict use of the Services if we believe your use violates these Terms, creates risk, is fraudulent, abusive or unlawful, or may harm Casopra, Shopify, our customers or service providers.

2. Our Products

Casopra offers curated wall art and related products. Many products sold through the Services are made to order and produced only after a customer places an order. Because products are produced specifically for each order, production, fulfillment, shipping, return and replacement rules may differ from rules that apply to mass-stocked retail products.

We have made every effort to provide an accurate representation of our products and services. However, colors, contrast, brightness, scale, texture, framing appearance, product proportions and overall visual appearance may differ from how they appear on your screen because of device type, display settings, browser settings, lighting conditions, print materials, production equipment, production location and the physical printing process.

You acknowledge that printing is a physical production process and that minor variations in color, finish, placement, texture, cropping, alignment or final appearance may occur. Such variations do not necessarily constitute defects. We do not warrant that the appearance or quality of any product will exactly match any image, rendering, mockup or preview displayed online.

All product descriptions, images, mockups, prices, offers and availability are subject to change without notice. We reserve the right to discontinue any product, modify a product or product presentation, and limit quantities or sales to any person, geographic region or jurisdiction on a case-by-case basis.

3. Orders

When you place an order, you are making an offer to purchase. Casopra reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Casopra confirms acceptance or begins processing. We must receive and process your payment before your order is accepted and fulfilled.

Please review your order carefully before submitting it, including product, quantity, size, shipping address, billing address, contact information and all other details. Because many products are made to order, Casopra may be unable to accommodate cancellation requests, address changes, size changes or product changes after an order has been accepted, submitted to production or begun processing.

If we do not accept, modify or cancel an order, we will attempt to notify you using the email address, billing address or phone number provided at the time of the order. We may cancel or refuse orders if information is inaccurate, incomplete, fraudulent, intended for resale, violates these Terms or creates risk for Casopra, our customers or providers.

Your purchases are subject to return, refund, exchange, replacement and cancellation rules set out in our Terms of Purchase, Delivery & Returns page, Shipping Policy and Return & Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or unauthorized export.

4. Prices and Billing

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless expressly stated, posted prices do not include taxes, shipping, handling, customs duties, import charges, brokerage fees or similar charges.

Prices posted in our online store may be different from prices offered through physical stores, marketplaces, third-party websites or other online stores. We may offer promotions governed by separate terms. If there is a conflict between promotion terms and these Terms, the promotion terms will govern solely for that promotion.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases. You agree to update your account and other information, including email address, billing information, shipping address, credit card information and expiration dates, so that we can complete transactions and contact you as needed.

You represent and warrant that your payment information is true, correct and complete, that you are authorized to use the applicable payment method, that charges will be honored by your payment provider, and that you will pay all charges at the posted prices, including shipping, handling, taxes and applicable charges.

5. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy and Delivery & Returns page, which are incorporated by reference. Delivery times are estimates only and are not guaranteed. Delivery time may include production time, fulfillment time, shipping time and carrier processing time.

Delivery may be affected by the product ordered, destination country, production location, order size, selected shipping method, carrier network status, customs processing, weather, holidays, high-volume periods and other circumstances outside our control. We are not liable for shipping or delivery delays caused by carriers, customs authorities, incorrect or incomplete addresses, failed delivery attempts, recipient refusal, unclaimed packages, international processing, force majeure events or other events outside our reasonable control.

Customers are responsible for providing a complete, accurate and deliverable shipping address. If an order is returned to sender, refused, unclaimed, undeliverable or disposed of because of an incorrect or incomplete address, failed pickup, recipient refusal or similar customer-side issue, the customer may be responsible for replacement production, reshipping, additional shipping charges or related costs, except where prohibited by law.

Risk of loss and title for products pass to you when the products are delivered to the carrier, except to the extent prohibited by applicable law or where Casopra expressly provides a replacement or remedy under our posted policies. This provision does not limit any rights you may have under consumer protection laws.

6. Intellectual Property

Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, designs, layouts, product descriptions, collections, content, and the design, selection and arrangement thereof, are owned by Casopra, its affiliates, suppliers, licensors or service providers and are protected by applicable copyright, trademark and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, scrape, copy or commercially exploit any material on the Services without our prior written consent. Except as expressly provided, nothing grants a license or other rights under any patent, trademark, copyright or other intellectual property of Casopra, Shopify or any third party.

Casopra's names, logos, product and service names, designs, slogans and other brand elements are trademarks of Casopra or its affiliates or licensors. You must not use such trademarks without prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other marks are the property of their respective owners.

7. Optional Tools

You may be provided with access to customer tools, features, integrations or functionality offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available" without warranties, representations or conditions of any kind and without endorsement.

We shall have no liability arising from or relating to your use of optional third-party tools. Your use of optional tools is at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which those tools are provided.

We may offer new features, tools, resources, personalization features, account features, social media features, artificial intelligence features, search features or other functionality. Such new features are part of the Services and subject to these Terms. If the Services include features that allow interaction with third-party social media platforms, you are responsible for complying with those platforms' terms, policies and community guidelines.

The Services may contain materials, hyperlinks, applications, integrations, embedded functionality or other content provided or operated by third parties. We are not responsible for examining or evaluating the content, accuracy, policies, security or practices of third-party materials or websites you access. If you leave the Services to access third-party sites, you do so at your own risk.

We are not liable for harm or damages related to your access of third-party websites or your purchase or use of products, services, resources or content on third-party websites. Please review third-party policies and practices before you engage in any transaction. Complaints, claims, concerns or questions regarding third-party products and services should be directed to the third party.

9. Relationship with Shopify

Casopra is powered by Shopify, which enables us to provide the Services. However, any sales and purchases you make through our store are made directly with Casopra. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sales between you and Casopra, including injury, damage or loss resulting from purchased products and services.

You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Casopra, except to the extent prohibited by applicable law. Shopify may process certain personal information in connection with the Services as described in our Privacy Policy and Shopify's applicable privacy notices.

We undertake no obligation to update, amend or clarify information except as required by law.

WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL CASOPRA, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PROCURED USING THE SERVICES.

This limitation applies to claims related to errors or omissions in content, loss or damage incurred as a result of the use of the Services, products, content or any other material made available through the Services, even if advised of their possibility. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you. Nothing limits liability that cannot be limited under applicable law.

You agree to indemnify, defend and hold harmless Casopra, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of your breach of these Terms or incorporated documents, your violation of law or third-party rights, your access to and use of the Services, your Feedback, your misuse of the Services or your fraudulent or abusive conduct.

We will notify you of an indemnifiable claim, provided that failure to promptly notify will not relieve your obligations unless you are materially prejudiced. We may control defense and settlement at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, not to be unreasonably withheld. You will cooperate in the defense of indemnified claims.

If any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the jurisdiction where Casopra is headquartered, without regard to conflict of law principles, except where applicable consumer protection laws require otherwise. You and Casopra consent to venue and personal jurisdiction in the courts of such jurisdiction, except where prohibited by law.

You can review the most current version of these Terms at any time on this page. We reserve the right, in our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website.
